General Terms For Commissioned Artwork
Unless modified by another more specific written agreement, this document contains the general terms and conditions for retaining Paivatar (the "Artist") to develop and deliver a commissioned work of art (the "Commission") for the Client.
1. Commission Information. The Client must provide a full description of the requested Commission, or a detailed Design Brief, in advance of the Artist commencing work and promptly respond to any e-mailed requests from the Artist for additional information and/or feedback. At a minimum the description provided by the Client should include the following:
A. Technical details such as dimensions, desired medium (digital, ink, water color, etc), and any applicable formatting requirements (image type, resolution, color palette, etc);
B. Artistic details such as pose, composition, amount and placement of empty space, background contents and image style (bust portrait, portrait from the waist up, full body, etc);
C. Any additional background and/or conceptual information that the Client would like the Artist to consider while developing the Commission (images, web site links, book summaries, etc);
D. If the Commission is to include copyrighted work not owned by the Artist then the Client must provide written proof that the Client is the copyright holder, an authorized representative of the copyright holder or a licensee of the copyright holder.
2. Payment Requirements. The Client must provide complete contact information including a contact name, billing address, e-mail address and telephone number. Upon completion of a review of the requested Commission the Artist will e-mail an invoice to the Client for the estimated amount of the fees, costs and out-of-pocket expenses, if any, that must be advanced prior to beginning work on the Commission. The invoice will list the Artist's fee and estimated costs including any applicable materials, shipping and/or processing costs. The Client must pay the invoice in full within 15 business days of the invoice date. The Artist will begin work on the Commission only after payment of the invoice in full has been received and the Client has provided all requested information.
3. Commission Completion. The Artist will provide the Client with an estimated time frame for beginning and completing work on the Commission. This time frame will be determined by the Artist based on the complexity of the Commission, the Artist's current schedule, and any other time-based factors agreed upon in advance in writing by both parties. After beginning work on the Commission, the Artist will produce one or more preliminary sketches and/or low-resolution water stamped images within reason and at the discretion of the Artist and e-mail them to the Client for consideration and feedback. The Artist will make a good faith effort to finish the Commission in a timely manner and will promptly notify the Client of any changes in the estimated time frame. The Artist will either e-mail to the Client the final high-resolution image or mail to the client via postal or similar service the final physical product as required and specified to complete the Commission.
4. Right of Refusal/Cancellation. The Artist reserves the right to refuse or cancel the Commission at any time. Any money paid by the Client to the Artist for the Commission will not be refunded or may be refunded in whole or part, in the Artist's sole discretion, depending on the Artist's time and resources spent in reviewing and/or working on the Commission prior to cancellation and/or costs spent. No refund of any portion of any money paid by the Client will be made to a Client who unilaterally cancels the Commission for any reason. Reasons why the Artist may refuse or cancel the Commission include but are not limited to the following:
A. Failure by the Client to satisfy any of the terms and/or conditions set forth in this document;
B. Failure by the Client to respond within 30 business days to any e-mailed or postal sent requests from the Artist for additional information;
C. Requests for pornographic images, any content that is illegal under the laws of the jurisdiction where it is to be created and/or the jurisdiction to where it will be sent and/or any subject matter which the Artist in her sole discretion deems offensive or inappropriate for her to create.
5. Ownership Rights. The Artist retains full rights and license to use, store, reproduce, display and/or publish the Commission including any preliminary sketches and/or final completed result (the "Commission product"). The Client is granted a non-exclusive license to use, store, reproduce and/or display the Commission product for personal use only. Any use or intended use of the Commission product by the Client for non-personal and/or commercial purposes must be negotiated and agreed to separately and in writing between the Artist and the Client. If the Commission product includes copyrighted material owned by or licensed to the Client, the Client agrees that the Artist may use the Artist's work on the Artist's personal website and/or other mediums for advertisement and/or display of the Artist's skills and past works only and grants the Artist a license for such purposes. All use, display and/or publication of the Commission product by either the Artist or the Client must include the name of the Artist and, at the Client's discretion, the name of the Client in an easily discoverable location.
6. The foregoing terms may be subject to modification and/or supplementation by additional written agreements between the Artist and the Client as may be necessary to fulfill the purpose of any particular Commission.

Shitstorm of a year
As the title announces this year has been a shitstorm of epic proportions. I'm not talking politics, now, so no need to worry that this will be a anti/pro Trump thing. Politics is infuriating but right now it's secondary to everything else.
In the beginning of the year I had the worst case of flu of my life that lasted for 4 weeks, and half of my head was an infected ball of misery. When I got better I started having pelvic pains that took me to an operating room, then a family member told me that they were in a controlling, verbally abusive relationship and as a cherry on top I heard that I had to have all four wisdom teeth yanked. Slow art spring
I have to apologize AGAIN to you all for the nearly complete lack of submitted art recently. I've been in pain for the past month and a half and it came to a head last Friday when I had surgery to remove the cause of that pain. I'm obviously still recovering so there's pain and discomfort, and I can't sit for long periods of time so creating anything is very hard right now. I promise that once I get back to my old self I will post more stuff!

Health issues
I have to apologize to all my wonderful watchers for the lack of new art on my part. I've had neck issues ever since the car accident I was in and it's to the point now where I get massive tension headaches every time I keep my head in one position for longer than 10 minutes. It's nearly impossible to work on the computer and doing traditional work is as difficult. I'm going to let my neck muscles heal properly before I even try to paint/draw anything since living with a constant dizziness and a strong enough pressure behind my eyes that I want to stick my head in a freezer to ease it really isn't how I want to spend my time. Car accidents suck
So... a week ago on Saturday my husband and I got into an accident and without any fault of our own our beloved 11 year old car was totaled and I hurt my neck enough to be mostly out of commission for the past week. The accident could have ended up much worse since our car was hit and it spun out on a four lane expressway. I have flashes of thinking "this will hurt like hell", "I really don't want it to end like this" and "holy shit I don't want anything bad to happen to my husband" as our car was sliding between other cars that were traveling at 70-80 mph on a road that resembled a small lake at that time due to excessive rain, while waiting
